- Subject of the contract
We are one of the leading brand suppliers of outdoor and camping goods. The goods shown in our web shop at portal-outdoor.com represent a non-binding catalog of goods and a request to the customer to submit an offer to purchase the goods (inventatio ad offerendum).
- Contract Conclusion
The customer can store items from our web shop in their shopping cart using the "Shopping cart" button, provided the goods are in stock. The checkout process is initiated by selecting the shopping cart and the button "Proceed to checkout". The checkout process for a single item is initiated directly when the customer selects the "Buy Now" button. The data for delivery and payment must be entered by the customer in the checkout process. By completing the checkout process using the "Purchase" button, the customer makes a binding offer to purchase the selected items.
The confirmation of the order receipt and the acceptance of the order takes place by automated email immediately after the completion of the checkout process. The contract for the purchase of the goods is concluded with this order confirmation.
Before completing the checkout process, the customer can check the content of the shopping cart and the order data entered by them and make changes at any time by selecting the respective order step and thereby correcting input errors.
- Prices and payment
The prices stated by us are inclusive prices including all statutory price components including sales tax in the applicable amount plus Shipping. The amount of the shipping costs will be shown to the customer in the ordering process. Free delivery in UK starting from £50.00.
The following payment methods can be selected: shopPay, GPay and Paypal.
- Right of withdrawal
Customers who are consumers (in terms of the § 13 BGB), distance selling has a statutory right of withdrawal. Consumers are natural persons who conclude a legal transaction for purposes that can primarily not be attributed to their commercial or independent professional activity.
The information on the right of withdrawal, in particular on terms, deadlines and procedures for exercising the right of withdrawal as well as the model withdrawal form are available under the menu item "Right of withdrawal".
The right of withdrawal does not exist in the case of delivery of goods which, on grounds of health protection or hygiene, are not suitable for returning if their seal was removed after delivery.
- Dispatch
Orders are shipped within 3 working days of receipt of payment. We ship with GLS and DPD. After the shipment has been dispatched to the shipping service provider, the customer receives a tracking ID from us, with which the delivery status of the shipment can be tracked at any time.
- Liability for Defects
The customer's liability for defects is based on the statutory provisions. We ask customers to check the shipments for possible transport damage immediately after receipt and to inform us of this promptly. If the customer does not comply with this, this has no effect on his liability for defects.
- Exclusion of liability
Claims of the customer for damages are excluded, unless it concerns damage claims from injury to life, limb, health, as well as liability for other damages which are based on an intentional or grossly negligent breach of duty by us or our vicarious agents. Furthermore, this disclaimer shall not affect the Company's liability for the violation of obligations that are essential for the proper fulfilment of the Agreement and upon whose observance the Distributor may normally rely. In the event of a slightly negligent breach of these contractual obligations, we shall only be liable for the foreseeable damage typical for the contract, unless the customer is entitled to compensation for damage to life, limb or health.
- Right of ownership, compensation
If the customer is a consumer, we reserve ownership of the purchased item until full payment of the purchase price. If the customer is an entrepreneur exercising a commercial or independent professional activity, or a legal entity under public law or a special fund under public law, the goods remain our property until settlement of all outstanding claims from the business relationship with the customer. The corresponding liens are transferable to third parties.
The customer only has a right to compensation if the alleged counterclaims have been legally established or have not been disputed or recognised by and are based on the same contractual relationship.
- Storage of contract terms, contract language
We save the terms of the contract and the customer data necessary to process the purchase contract; we do not pass on data to third parties without authorisation. The data will be deleted after completion of the contract and after expiry of the statutory warranty rights. The customer can request stored data from us at any time and in any possible means of communication, we will provide information promptly.
German is the customer's contract language.
- Final provisions
All contracts with us are subject to German law excluding the UN sales law. The choice of law applies to consumers only insofar as this does not restrict consumer-protecting standards in the home country (principle of favourability). For all legal transactions in which a consumer is not involved, our place of business is agreed as the place of jurisdiction.
